These Terms of Service ("Terms") govern your access to and use of the services provided under the CardFax brand by TradingCard360, LLC ("CardFax," "we," "us," or "our"), including the CardFax website, grading platform, public registry, Registry API, applications, browser extensions, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility and Accounts

1.1

You must be at least the age of majority in your jurisdiction and otherwise legally able to enter into binding contracts to use the Services.

1.2

To access certain Services, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

1.3

You agree to update your account information promptly if it changes.

2. Submissions and Use of Services

2.1

To use grading or related Services, you must complete all required steps in the submission process and pay applicable fees.

2.2

You represent that you have lawful ownership or authorization to submit any items you submit to CardFax.

2.3

Submission of any item does not guarantee grading outcomes, specific turnaround times, or other results. Processing times are estimates and may change based on volume and operational factors.

2.4

Pregrades are condition opinions produced from photographs. They are not registered grades, are provided for informational purposes only, and must not be represented as registered CardFax grades.

3. User Content and User Responsibilities

3.1

You are solely responsible for any content or data you submit to the Services, including card images, metadata, and related information.

3.2

You agree not to submit content that is unlawful, harmful, misleading, or infringes the rights of others.

3.3

CardFax may remove or disable access to any user content at any time for any reason.

4. Fees, Payments, and Billing

4.1

You agree to pay all applicable fees associated with the Services you request. Fees may change at any time, and updated pricing will be posted on our website.

4.2

Payments must be made in full before Services are provided. There are no refunds for completed Services unless required by applicable law.

5. Limitations of Liability and Disclaimers

5.1

To the fullest extent permitted by law, CardFax and its affiliates disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

5.2

CardFax does not guarantee the authenticity, accuracy, completeness, or reliability of any grading, pregrading, or analysis. Any decisions you make based on Services obtained through our platform are at your own risk.

5.3

In no event shall CardFax be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if advised of the possibility of such damages.

6. Indemnification

You agree to indemnify, defend, and hold harmless CardFax and its officers, directors, employees, agents, and affiliates from any claims, liabilities, losses, damages, costs, or expenses (including reasonable attorney fees) arising out of your use of the Services, your user content, or your violation of these Terms.

7. Intellectual Property

7.1

All content, software, and technology used in connection with the Services are owned by TradingCard360, LLC or its licensors and protected by copyright, trademark, and other intellectual property laws.

7.2

You may not copy, reproduce, modify, distribute, create derivative works, or publicly display any of the Services without our express written permission.

8. Dispute Resolution

8.1

These Terms will be governed by the laws of the State of Colorado, without regard to its conflict of laws principles.

8.2

Except where prohibited by law, any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in Colorado under the rules of the American Arbitration Association. The arbitration will be conducted in English and judgment on the award may be entered in any court having jurisdiction.

9. Changes to Terms

We may modify these Terms at any time by posting a revised version on our website or notifying you electronically. Your continued use of the Services after such changes constitutes acceptance of the updated Terms.
